Like the former Telecom Minister A. Raja, DMK MP Ms. Kanimozhi too tried to implicate the Prime Minister Manmohan Singh and the then Finance Minister P. Chidambaram in the 2G spectrum scam.
Kanimozhi’s lawyer Sushil Kumar told the special CBI judge OP Saini today that Manmohan Singh and Chidambaram, along with the then communications Minister A. Raja have decided not to sell or auction the licenses for the 2G Spectrum scam.
“They are clearly in the loop for directly allotting the licenses with out auction or a sale process,” said the counsel and requested the court to discharge his client from the case. Both Raja and Kanimozhi are now in Tihar jail.
He further said that the CBI’s case was based on the premise that the accused caused huge losses to the state exchequer by deciding not to auction the licenses. “Since the loss is presumed, there is no actual loss. Since there is no loss factor, the cheating charge too goes out,” he said and requested the court to discharge his client.
Observing that notional losses can’t be a ground for seeking prosecution, the counsel said that the Lok Sabha has not even adopted the CAG report which said a loss of Rs.1.76 lakh Cr occurred to the state exchequer as the licenses were not auctioned or sold.
