DMK MP Kanimozhi and 6 other accused in 2G scam, will spend Diwali in jail as the court of Special Central Bureau of Investigation (CBI) Judge OP Saini reserved its order on her bail application till November 3.
The court reserved the bail application of Kanimozhi along with Kalaignar TV MD Sharad Kumar, Cineyug Films' founder Karim Morani, and Kusegaon Fruits and Vegetables Chief Executives Asif Balwa and Rajiv Agarwal.
While replying to Kanimozhi's lawyer Altaf Ahmad argument, the CBI told the court that it did not want to oppose the bail to Kanimozhi in the 2G case.UU Lalit, the CBI prosecutor told the Special CBI Court that the investigating agency had no objection in granting bail to Kanimozhi, Kalaignar TV MD Sharad Kumar, Cineyug Films' founder Karim Morani, and Kusegaon Fruits and Vegetables Chief Executives Asif Balwa and Rajiv Agarwal.
However, the CBI opposed the the bail application of DB Realty promoter Shahid Balwa and former telecom minister A Raja's former private secretary RK Chandolia.
Earlier, arguing strongly for bail, Ahmad told the court that the investigations into the 2G spectrum allocation case were over and charges framed, so there was no question of tampering with evidence and the custody of the accused was not required.
Ahmad also said that the court could impose heavy conditions if it wanted for granting bail and can ask that the accused be available whenever asked to appear.
Kanimozhi has been charged for accepting bribes, criminal conspiracy to cheat the exchequer and criminal breach of trust and has been in Tihar Jail since May 2011.
