Act tough on hate speeches: Supreme Court

Supreme Court of India has on Wednesday directed the police to act tough on political leaders who get indulged in hate speeches and also suggested to de-recognise the parties if found guilty.

A bench headed by Justice B S Chauhan refused to frame guidelines to prevent leaders from making provocative speeches but has request the Law Commission to examine the issues raised thoroughly  and make recommendations to the Parliament to strengthen the Election Commission to curb the danger of hate speeches irrespective of whenever and whoever made.

The Apex court opined that the problem is not the absence of laws but rather a lack of their effective execution. Justices M Y Eqbal and A K Sikri said, “Effective regulation of hate speeches at all levels is required as the authors of such speeches can be booked under the existing penal law and all the law enforcing agencies must ensure that the existing law is not rendered a dead letter.”

The Court added that it cannot re-write the legislation as it has no power.
