In an effort to make the Investigating Agency autonomous to curb the possible interference of the Government like in the case of Coalgate Scam in which the Law Minister and PMO office were allegedly interfered in the statement that was to be submitted to the Supreme Court of India.
The Government proposed it in a 41 page affidavit it submitted to the Supreme Court, on the basis of the recommendations made by the GoM appointed for that purpose.
As per the affidavit, the main features are like this-
The Director of CBI will be appointed by the committee comprising of the Prime Minister, Leader of opposition party in the Parliament and Chief Justice of India or an SC Judge for which PM will be the Chairman. The tenure of the Director of CBI is to be limited 2 years and the Director will be transferred only with the consent of the committee. Only President is empowered to remove a CBI Director. In case of any allegations on the CBI officials, an Accountability Commission will hold the inquiry.
Another strong point given in the affidavit is the Government is not to influence in any of the investigations CBI conducts. The Supreme Court previously called the CBI as a parrot in a cage speaking of what Government wants it to say, when the fact of interference came to light and asked the Government to liberate CBI with some measures to attain it in response to which the Government submitted an affidavit today with its proposal to achieve it.
