The tech giant from Cupertino, Apple Inc had been trying to get a speedy ban imposed on Samsung Samrphones which were proved to emulate the looks and technology developed by Apple. The news comes right after the court's decision had proved that Apple's patents have been infringed by the South Korean company.
The Apple Inc, which would soon be releasing the Apple iPhone 5 on September 12, has made a quick move identifying the major targets eight smartphones which also include the widely popular Samsung Galaxy S2 (GT- I9100) and the Droid Charge. The initial action was against 28 devices at least but most of the models were not available today in the market. Still the ensuing ban on the smartphons would be a tangible profit in terms of market share to the Apple Inc.
The flagship mobile of Samsung Galaxy SIII was not included in the trial but the jury had declared the infringement of the patents based on the features and design of the phones from Apple which made it eligible to launch claims against SIII too.
But this is more of a strategic move by the Apple, as it may use the "Contempt Proceeding" against the SIII as the case moves faster than the other trials.
Apple has gained a lot of momentum, opine the Wall Street experts, after it had almost won over the South Korean Company. All the evidences and odds are now in favor of Apple. The bad news for Samsung is that it has just over 33% chances of winning the trials. An injunction hearing has been scheduled on September 20th. If US District Judge Lucy Koh grants sales bans, Samsung will likely seek to put them on hold pending the outcome of its appeal.
Samsung news had mentioned that it would make sure that certain changes as necessary would be made so that the products are available in the US. The company has also reportedly entered into talks with the carriers to ensure that the infringing features be modified such that they would be available in the market.
Samsung said it will take all necessary measures to ensure the availability of its products in the US market. A source familiar with the situation said Samsung has already started working with US carriers about modifying infringing features to keep products on the market should injunctions be granted.
The victory of the US company in the Samsung Apple case has put it further ahead in the market today just before the release of the Apple iPhone 5 and a speculated launch of the smaller iPad in the follwing month. The case also forces the mobile operating based on Google's Android OS to make structural changes.
Samsung pays apple $1.05 billion after the damages caused by the infringement of designs of iPad and iPhone if the final verdict too is in favor of Apple like the previous verdict in California court.
Meanwhile Apple stocks seem to be rising gradually as they have reached another high today.
The ban would soon be expected to include the Samsung Galaxy SIII and the ban if imposed would further strengthen the position of Apple in the US market while distancing Samsung from the top slots. Samsung would also possibly ponder the launch of its newer devices and postpone them to avoid the infringement.
