Supreme Court of India on Friday had rebutted the proposal to subdue the 37-year long trial relating to the former railways minister L N Mishra's murder back in 1975.
The court had already been handled by 30 judges so far and every one of them had tried to do their best for a speedy and efficient trial, the SC said. As the delay hence cannot be blamed on the system and the trial cannot be quashed.
The accused had sought the interference from the apex court after it had asked for a day-to-day trial to expedite the procedures but it had not happened in reality. He complained that this was a reach of the fundamental right to speedy justice.
The SC however rejected the request for repressing the 37 year old trial and had asked the trial court to hold trials everyday to ensure that an expeditious completion of the trial.
