CBI Court did not accept the charges levied by CBI on YS Jagan and Vijaya Sai Reddy under IPC section 409 and Section 12 of PC Act. But it is of no relief for them.
Section 409 of The Indian Penal Code deals with the Criminal breach of trust by public servant, or by banker, merchant or agent. Section 12 of The Prevention Of Corruption Act deals with the punishment for abetment of offences defined in section 7 that a public servant taking gratification other than legal remuneration in respect of an official act.
As both the charges pertain to Government servants, the CBI Court dropped the above two charges on YS Jagan and Vijaya Sai Reddy, keeping other charges intact. As such it gave no relief to them.
