The one time IPL champion, Deccan Chargers would remain terminated after the status quo order passed by an arbitrator was rebutted by the Judge. The order passed was not higher than the decision of the Bombay High court since it was passed by an arbitrator.
The decision to quash the order passed by the arbitrator of the high court was quashed by Justice RD Dhanuka, after he was appointed by the high court to settle the case between the BCCI and the Deccan Chronicles Holdings Limited (DCHL).
DHCL in another case filed a petition against its termination as an IPL, the court refused to give any interim relief but it said that the arbitrator had the final say in determining the legality of the termination.
With both the cases turning against the DHCL, the Deccan Chargers may not be seen in the IPL as of the developments now.
CK Thakker was the arbitrator, a retired supreme court judge, who passed an order for a status quo which had forced the BCCI to move to high court.
Dhanuka mentioned that the arbitrator was in no power to grant the status quo since the order was from the high court. The plea for an extension of time to DCHL for the payment Rs 100 crore bank guarantee was denied by the court on October 1.
Lashing at the arbitrator Justice Dhanuka said, "Once the high court has rejected relief, the plea made before the arbitrator is not maintainable."
