Uber rape case: Driver Shiv Kumar Yadav found guilty

Uber cab driver Shiv Kumar is found guilty of raping a 25 year old woman in the taxi, on the last December.

In the past, Uber rape case went viral in the media and the company immediately suspended the driver from the post. Upon several investigations, finally the court has now declared Shiv Kumar to be guilty in the rape case.

On December 5th last year, a woman working as the finance executive in Gurgaon, was returning to her house in Inderlok, from the office. It was on that night, the rape took place, harming the woman on several parts of the body.

The driver was arrested on December 7 and is currently in the judicial custody.

Speaking about the case, in the past, special Public Prosecutor Atul Shrivastava said that, an accused can be convicted on the basis of the sole testimony of the survivor, if the testimony is trustworthy.

He said that 28 prosecution witnesses is a more than sufficient evidence on the record to hold Shiv Kumar guilty.  

 

On the other side, advocate D K Mishra, said, “There are several false allegations on his client Shiv Kumar. The woman changed her statements before the court and the police.”

In the past, keeping the Delhi high court order aside, the Supreme Court had allowed the reexamination of 13 prosecution witnesses, including the victim, after the woman and Delhi police had reached the apex court.

The proceedings in the case took may stay orders in the Supreme Court from March 10 to September 10, i.e., for six months.

The trial court had framed the charges against Shiv Kumar for the alleged offences of raping a woman, abduction with intent to compel her for marriage and criminally intimidating and causing hurt.

The court even recorded the testimony of the accused in which he said that the allegations on him are purely baseless.

Finally, Shiv Kumar’s sentencing is scheduled for October 22nd. The woman's father is found relieved after the judgment.
